Trademark Renewal
Keep your registration active.
A federal registration doesn't last forever on its own — it stays alive only if you file maintenance paperwork on schedule.
Maintenance filing deadlines
- Years 5–6
Declaration of Use
File a Section 8 declaration confirming your mark is still in use in commerce.
- Years 9–10
Combined Declaration & Renewal
File a combined Section 8 & 9 filing to renew your registration for another 10 years.
- Every 10 years after
Ongoing renewal
Repeat the combined filing every 10 years to keep your registration active indefinitely.
What happens if you miss a deadline
Missing a maintenance deadline can cause your registration to be cancelled or expire. The USPTO allows a limited grace period for some filings, but once it passes, you may need to reapply from scratch — losing your original filing date and priority.
Don't let your registration lapse.
