Prove your mark is in commerce.
If you filed based on an intent to use your mark, a Statement of Use is the final step to complete your registration.
When is it required
If your trademark application was based on an "intent to use" your mark rather than actual use, the USPTO requires proof that you've started using it in commerce before registration is finalized. This proof is called a Statement of Use, and it's due after the USPTO issues a Notice of Allowance.
What you'll need to provide
Have these ready before you file:
- The date you first used the mark in commerce
- A description of the goods or services it's used for
- A specimen showing the mark in actual use (e.g. packaging, a screenshot of your site)
- Payment of the USPTO filing fee
